1. Who we are
The Sudoku Battle mobile game (the “App”) and its associated services (together, the “Service”) are provided by:
- Provider: Carles Garcia
- NIF: 46988642X
- Contact email: hello@sudokubattleapp.com
This information is provided in compliance with Article 10 of Spanish Law 34/2002 on Information Society Services and Electronic Commerce (LSSI-CE).
2. Acceptance of these Terms
These Terms and Conditions (the “Terms”) govern your access to and use of the Service. By using the App you confirm that you have read, understood and accepted these Terms and our Privacy Policy. If you do not agree, do not use the Service.
3. The Service
Sudoku Battle is a Sudoku game. Depending on what you choose to play, the Service includes:
- ranked matches: real-time one-against-one matches in which both players solve the same puzzle, which change your points, level and position in the rankings;
- friend challenges: unranked matches against a friend you invite;
- practice: solo puzzles played on your device;
- friends, friend codes and shareable links, a global ranking, match history, push notifications and profile settings.
Opponents. To keep waiting times short, a ranked match may be played against a computer-controlled opponent, and some entries in the rankings may be computer-controlled players. They play by the same rules as everyone else. Friend challenges are always played against the friend you invited.
Rules. The rules of the game — time limits, mistake limits, points, levels and arenas — are shown in the App and on our website, and the game server applies them. We may adjust them to keep the game fair and balanced (see Section 9).
The Service needs an internet connection, except for playing a practice puzzle you have already started.
4. Eligibility and accounts
4.1 Age. You must be at least 14 years old to use the Service. If you are under 18, you need the permission of a parent or legal guardian, who must also agree to any purchase.
4.2 Guest and linked accounts. When you first open the App we create a guest account linked to your device. You can link an email address and password (or another sign-in method the App offers) to keep your progress across devices. A guest account that is not linked can be lost if you delete the App or change device, and we cannot recover it.
4.3 Usernames. We assign you a username, which you can change. Usernames are public (for example in the rankings and to your opponents). They must not be offensive, impersonate anyone or infringe anyone’s rights; we may change a username that breaks this rule.
4.4 Account security. Keep your password and any code we send you confidential. You are responsible for the activity under your account. Tell us at hello@sudokubattleapp.com if you suspect unauthorised use.
4.5 One person, one account. Accounts are personal and non-transferable. You may not sell, buy or share accounts.
5. Fair play
You agree not to:
- use solvers, bots, scripts, modified clients or any tool that plays for you or gives you an unfair advantage;
- deliberately lose, arrange results with other players, or use several accounts to boost your ranking;
- exploit bugs instead of reporting them to us;
- harass other players, or use offensive usernames;
- reverse engineer, decompile or interfere with the App or the game servers, except to the extent applicable law (e.g. Directive 2009/24/EC) does not allow this to be restricted;
- probe, disrupt or overload the Service, or access it by automated means.
We may take proportionate measures against breaches, including resetting points or levels, removing results from the rankings, changing usernames, and suspending or terminating accounts (see Section 10).
6. Purchases
6.1 What you can buy. The game is free to play. Optional purchases are shown in the Shop with their price (including VAT) before you buy:
- Yearly subscription — removes ads and opens every arena, for one year at a time (see 6.3);
- Arena passes — one-time purchases, each opening one arena above your own. A pass stays on your account; it is no longer offered once its arena is unlocked for you.
6.2 Store billing. Purchases are made through the Apple App Store (or another app store we make the App available in) and are subject to its terms. We never receive or store your card or bank details. We validate each purchase with the store before granting it to your account.
6.3 Automatic renewal. The yearly subscription renews automatically every year at the then-current price unless you cancel it at least 24 hours before the end of the current period. Cancel at any time in your iPhone’s Settings → your name → Subscriptions; you keep its benefits until the end of the period already paid; the arenas it opened close again unless you have reached them or own their pass. Deleting the App or your account does not cancel a subscription.
6.4 Price changes. A change to the subscription price applies only from a later renewal; the store will notify you in advance and you may cancel before it takes effect.
6.5 Digital content and the right of withdrawal. As a consumer in the EU you normally have 14 days to withdraw from a distance contract. Arena passes and the yearly subscription are digital content and services supplied immediately after purchase. By completing the purchase you request immediate supply and acknowledge that you lose the right of withdrawal once supply has begun, to the extent the law allows. Refunds for purchases are handled by the store under its own procedures; you may also contact us at hello@sudokubattleapp.com.
6.6 No cash value. Passes, benefits, points, levels and rankings have no monetary value, cannot be exchanged for money and cannot be transferred to another account.
6.7 Statutory guarantee. As a consumer you benefit from the statutory guarantee of conformity for digital content and services under Spanish Royal Legislative Decree 1/2007 (TRLGDCU) and Directive (EU) 2019/770.
7. Advertising
The free version of the App shows ads, for example after a match result, served by Google AdMob. Where the law requires it we ask for your consent before showing personalised ads, and iOS asks for permission before any tracking. If you decline, you can play exactly the same game with non-personalised ads. The yearly subscription removes ads altogether. Ads are limited to content suitable for a general audience. See the Privacy Policy.
8. Intellectual property
The App, including its software, puzzles, design, trademarks (including “Sudoku Battle”), logos, texts, sounds and graphics, is owned by the Provider or its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to install and use the App on devices you own or control, for personal, non-commercial use, in accordance with these Terms and the applicable store rules.
9. Availability and changes to the Service
We work to keep the Service available but do not guarantee uninterrupted operation; maintenance, updates or events beyond our control may interrupt it. If the Service is interrupted during a match, the result recorded by the game server applies.
We may modify features of the Service for valid reasons (such as game balance, technical evolution, security or new legal requirements). If a modification negatively and more than insignificantly affects a feature you paid for, we will inform you in advance and you may terminate the contract free of charge within 30 days of being notified.
You may need to update the App to keep playing: the game server may refuse versions that are too old to play fairly.
10. Suspension and termination
10.1 By you. You may stop using the Service and delete your account at any time, in the App (Profile → Account → Delete account) or on our website at sudokubattleapp.com/delete-account. Deletion is permanent and removes your progress and the purchases tied to the account.
10.2 By us. We may suspend or terminate your access, in whole or in part, if you materially or repeatedly breach these Terms (including Section 5), if the law or a competent authority requires it, or if we discontinue the Service — in that case with reasonable advance notice and, where applicable, a proportional refund of any prepaid subscription period through the store. Where proportionate, we will warn you first and give you a chance to remedy the breach.
11. Liability
11.1 Nothing in these Terms excludes or limits our liability for wilful misconduct (dolo) or gross negligence, for death or personal injury caused by our negligence, or any other liability that cannot be excluded or limited under Spanish law. Nothing in these Terms limits your statutory rights as a consumer.
11.2 Subject to Section 11.1, we are not liable for losses caused by your breach of these Terms, by other players, by your device or internet connection, or by third-party services outside our control (including the app stores and push-notification networks).
11.3 Subject to Section 11.1, our total liability arising out of the Service in any 12-month period shall not exceed the amounts you paid for the Service in that period.
12. Personal data
We process personal data as described in our Privacy Policy.
13. Changes to these Terms
We may amend these Terms for valid reasons, such as changes in the law, in the Service or in our business. We will announce material changes in the App or on our website at least 30 days before they take effect. If you do not agree, you may stop using the Service and delete your account before they apply; continued use after the effective date constitutes acceptance. Changes will not retroactively reduce rights you have already acquired.
14. Governing law and disputes
14.1 These Terms are governed by Spanish law. If you are a consumer habitually resident in another EU member state, you also benefit from the mandatory consumer protections of that state.
14.2 Any dispute will be submitted to the courts of the consumer’s domicile, as provided by Spanish procedural and consumer law.
14.3 Before going to court, you can address any complaint to us at hello@sudokubattleapp.com; we will respond within one month. We are not currently adhered to the Spanish consumer arbitration system (Sistema Arbitral de Consumo). This does not affect your right to approach your local consumer office (OMIC) or to bring a claim before the courts.
15. Miscellaneous
- Severability. If any provision of these Terms is held invalid, the rest remains in force.
- No waiver. Our failure to enforce a provision is not a waiver of it.
- Assignment. You may not assign this contract. We may assign it to a successor of the business, provided your rights are not reduced.
- Languages. If these Terms are offered in several languages and they differ, the Spanish version prevails, without prejudice to the mandatory consumer protections of your country of residence.
